Regulatory update

September 2, 2011 — The U.S. Department of the Treasury has released its 2011–2012 Priority Guidance Plan (PDF), which includes a project to update Revenue Procedure 92-94, the guidance document for equivalency determination.

The Council on Foundations and TechSoup Global have been urging the Treasury to update this revenue procedure since 2009. The proposed revisions could address technical issues — such as changing the way the IRS determines whether the public support test has been met — and could include guidance on how the IRS might permit grantmakers to rely on equivalency determination information repositories (EDIR), including NGOsource.

That this project is included as a priority in the Treasury's guidance plan is a significant step forward for NGOsource, although it does not guarantee that the IRS will move beyond the technical issues.
